Help For Hosters

"Help4Hosters" refers to the Help4Hosters company providing server monitoring services under and complying with all of the terms of this Agreement.
"You" refers to an individual or a company that desires to substantially reduce the cost of its information technology services and wishes to purchase the server monitoring services from Help4Hosters.
By using the Help4Hosters Services, as our Customer you agree to all of the terms and conditions of this Agreement. If you do not agree to these terms, or any other Terms and Conditions posted on the Help4Hosters web site, all services will be discontinued. 


Term of the Agreement

This Agreement shall commence on the day when you order the Server Monitoring plan, 1 month ("Effective Date") and continue for 1 (one) month ("Term") starting form the Effective Date. 


Services available in the  Server Monitoring plan, 1 month

Upon the terms and subject to the conditions of this Agreement, Help4Hosters will provide to you the security, availability and monitoring services of one (and only one) of your servers  (collectively, "the Server Monitoring Services") that shall consist of the following:
- Performing regular (twice a week) security scans of your server to discover vulnerabilities, such as breaches or holes, in your system. 
- Monitoring of HTTP; HTTPS; FTP protocols and  Mail Servers (POP3 Servers; SMTP Servers; IMAP Servers); Telnet Servers; SSH Servers; DNS Servers  7 days a week.
- Notifying you via email or SMS about serious irregularities or troubles such as the monitored service being down. Notifications include the local date and time, server name and type, the reason for the failure, an error number/error message and a traceroute. 
- When the monitored service is available again you get an email/SMS containing the confirmation of the service indicated in the failure notification being up. 
  Help4Hosters will provide the Server Monitoring Services to you for the duration of the Agreement. You agree that Help4Hosters is responsible only for providing the Server Monitoring Services, and Help4Hosters is not responsible for providing any services or performing any tasks not specifically set forth in the Agreement.

You shall provide Help4Hosters, at no charge, with necessary, accurate, and reliable
information, data,  required by Help4Hosters to perform the Server Monitoring Services (the "Confidential Data"), including the IP of the server, the protocols and servers out of Services available in the  Server Monitoring plan to be monitored on your server. 
You guarantee that all the protocols and servers on the server to be monitored by Help4Hosters are in working order when you purchase the Server Monitoring plan.
You undertake to pay for the Server Monitoring Services rendered by Help4Hosters fully and in time in accordance with Pricing set forth in the Agreement.


Responsibility of Help4Hosters

Help4Hosters guarantees that all Confidential Data that Help4Hosters shall receive while
communicating with you at any time will not be sold, shown or lent to any third party,
including any commercial, municipal or government institution. 

If there is one of the following reasons: a denial of service attack, virus, high data traffic on the monitored server whereby the technicians of Help4Hosters cannot access the server, server monitoring services can not be rendered and Help4Hosters cannot be held responsible for action or inaction related to the services laid out in the Agreement.

Pricing. 
Payment of Fees for Server Monitoring plan, 1 month

Fees to Help4Hosters are due and payable on the following schedule:
Purchase of one Server Monitoring plan, 1 month is 50.00 (fifty) US dollars.
A deposit of one hundred percent (100%) of the cost of one  Server Monitoring plan, 1 month is required to commence work.
Payment to Help4Hosters will be made in US dollars with credit card through 2CheckOut.com. 


Termination of the Agreement. Refund Policy

Termination of the Agreement. 
This Agreement shall terminate (i) upon expiration of the Term; or (ii) upon ten (10) days advance written notice of termination from you that you are willing to terminate the Agreement. Your letter of termination will be effective upon receipt by Help4Hosters.
Upon termination, Help4Hosters will be reimbursed for all costs and non-cancelable
commitments incurred in the performance of the scope of work and for which you have not yet paid.
Refund Policy.
If you apply by a registered letter for a refund, work already completed shall be billed at the daily rate of $2 (two) US dollars and deducted from the initial payment. If the work that has been completed is beyond the amount covered in the initial payment, you shall be liable to pay for all work completed at the daily rate of $2 (two) US dollars.


MISCELLANEOUS

This Agreement represents the complete and exclusive statement of the agreements concerning these services between you and Help4Hosters and supersedes all prior agreements and representations between you and Help4Hosters.

THE ACCEPTANCE OF ANY PURCHASE ORDER PLACED BY YOU IS EXPRESSLY MADE CONDITIONAL ON YOUR ASSENT TO THE TERMS SET FORTH IN THIS AGREEMENT.
